Please read these terms carefully. By making payment toward any invoice for our services, you agree to be bound by the Terms of Service set out below.

Our Terms of Service

These terms apply to all services offered by The Tech Desk, including web design, custom software development, WordPress plugins, hosting, AI services and any additional services rendered.

1. Acceptance of Terms

By making any payment toward an invoice issued by The Tech Desk for any of our services — including but not limited to web design, custom software, plugins, hosting, AI services or additional add-ons — the client confirms that they have read, understood and accepted these Terms of Service in full.

Payment of an invoice (in part or in full) constitutes a binding acceptance of this agreement, whether or not a separate signed document is in place.

2. Proposal Acceptance & 15-Day Cancellation Window

Once a client has accepted a website or custom software proposal from The Tech Desk, they have a window of 15 (fifteen) days from the date of acceptance to cancel the project.

After the 15-day cancellation window has lapsed, the project is deemed confirmed and the client may no longer cancel under this clause. Any deposits or payments made will be allocated toward work already scheduled or completed.

3. Client Responsibilities & Information

Once a project is started, the client is responsible for providing all required information, content, branding, login credentials, product details, images, copy and any other material reasonably requested by our team to complete the project.

If the required information is not provided within a reasonable timeframe, the client accepts full responsibility for any delays, gaps, placeholders or limitations in their final website, plugin or custom software deliverable. The Tech Desk cannot be held liable for incomplete features or delayed launches caused by missing client information.

4. Cancellation After Project Has Started

A client cannot cancel a website or custom software project once the project has officially started and a period of 30 (thirty) days has passed from the project start date.

Refunds, where applicable, may only be considered by mutual agreement between the client and The Tech Desk team. Any refund granted will be calculated after deducting the value of all work already completed, including but not limited to design, development hours, third-party purchases, plugins, licences and any project management time.

5. Hosting & Domain Fees

Hosting is a monthly recurring service. The client is responsible for paying their monthly hosting and domain fees on time, even if the website or software project has not yet been concluded. This is due to the ongoing cost of server resources, domain registration and keeping the account live.

Hosting fees are billed monthly in advance and are non-refundable for any month already commenced.

6. Late Payment & Reconnection Fees

If a hosting or domain invoice is not paid within 7 to 15 days of the due date for that month, the service may be suspended. The client will then be liable to pay a reconnection fee, in addition to the outstanding hosting amount, before the service is restored.

The Tech Desk reserves the right to remove a website or suspend access to a hosted service where payment remains outstanding beyond a reasonable period.

7. Cancelling Hosting Services

If a client wishes to cancel their hosting service, they are required to provide a 30 (thirty) day written notice of cancellation. The client must pay for their final month of hosting and ensure their hosting account is fully up to date before the cancellation can be processed.

The client is required to provide all necessary details for the transfer of the domain and/or website to their new provider. Where a website exists on the domain, The Tech Desk will provide a backup of the website as part of the offboarding process.

8. Additional Services — No Refunds

For all additional services — including but not limited to plugin licences (TTD POS, TTD Boost, TTD Guard, TTD Agent), AI services, custom print designs and printing, content updates, design tweaks, SEO, email setup, integrations, training and consulting — there are no refunds once payment has been completed.

By completing payment for any additional service, the client confirms that everything is in order and that the payment concludes the service.

9. Design Approval & Refund Policy

During every project, clients will be consulted regarding designs, layouts, colours, content placement and any required changes or adjustments. Once a client confirms in writing (email, WhatsApp or ticket reply) that the design or deliverable is approved and "all is good", the work is considered final.

Once approval has been given, the client cannot subsequently request a refund for that scope of work. Further changes after approval may be quoted as additional billable work.

10. Plugin Licences & Subscriptions

All premium plugins offered by The Tech Desk operate on a licence-based model (monthly or annual). Licences are tied to the agreed number of activations and remain active only for the period paid. Expired licences will disable premium features until renewed; client data and settings remain intact.

Plugin licence fees are non-refundable once activated, except where covered by a specific written money-back guarantee on the product page.

11. Custom Software Development

Custom software projects (such as POS systems, booking platforms, AI integrations and bespoke business tools) are scoped and quoted individually. The scope agreed in the proposal forms the basis of the deliverable. Any features, modules or changes outside of the agreed scope will be treated as additional work and quoted separately.

Source code, ownership and licensing terms for custom software are governed by the individual project agreement.

12. Limitation of Liability

The Tech Desk shall not be held liable for any indirect, incidental or consequential losses arising from the use of our websites, plugins, custom software or hosting services. Our maximum liability in any matter shall not exceed the amount paid by the client for the specific service in question.

13. Changes to These Terms

The Tech Desk reserves the right to update or amend these Terms of Service at any time. The latest version will always be published on this page. Continued use of our services after an update constitutes acceptance of the revised terms.

14. Governing Law

These Terms of Service are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in good faith between the parties, failing which the matter shall be resolved under South African jurisdiction.
